A dispute over a parking space at a Florida Walmart ended with a man dead and a woman facing no criminal charges after prosecutors determined she was protected under the state’s self-defense law.
The incident happened on June 30 at a Walmart in North Lauderdale, Florida. According to prosecutors, Melissa Payne was involved in a confrontation with 65-year-old Bart DiGuglielmo over a parking space.
The situation escalated after DiGuglielmo allegedly became increasingly angry and confronted Payne. Prosecutors said he had threatened to damage her vehicle and later returned to the area where Payne was sitting in her car with her infant niece.
Witnesses described DiGuglielmo as visibly angry and shaking as he approached. Payne repeatedly warned him to stay back, according to the state attorney’s review.
Payne eventually got out of her vehicle carrying a cellphone and a firearm. When DiGuglielmo continued approaching her, she fired one shot, striking him in the abdomen. He was taken to a hospital but later died from his injuries.
The confrontation was captured by surveillance cameras and cellphone footage. Prosecutors said the video and witness accounts supported Payne’s claim that she reasonably feared for her safety.
The Broward County State Attorney’s Office ultimately determined that Payne was immune from prosecution under Florida’s “Stand Your Ground” law. Prosecutors said the evidence did not allow them to disprove her claim of self-defense by the legal standard required under Florida law.
The decision means Payne will not face criminal charges over the fatal shooting. The case has nevertheless drawn attention because a dispute that began over something as ordinary as a parking space ultimately ended with a man dead and a woman legally protected from prosecution.
