Erika Kirk has issued a formal request to try to have a Utah court enforce her right to a speedy trial in the case against Tyler Robinson.
The 22-year-old killer was reportedly charged with fatally shooting her partner during a Turning Point USA event that occurred last September.
In those court documents filed on January 16, her attorney continued to argue about how Robinson's defense team was engaging in delaying tactics that slowed down the judicial process.
While the US Constitution guarantees a fair trial for all defendants, this filing has stressed that it doesn't grant any right to delay proceedings indefinitely.
Under the latest Utah law, all victims are entitled to a timely resolution of criminal charges that are free from unwarranted delay.
Erika's motion requests that the judge consider this while setting out a new trial schedule.
One of the points of contention in focus has to do with the defense's effort to disqualify the Utah County Prosecutor's Office.
